Social Security Appeals Council

There are roughly 160,000 claims pending at the Social Security Appeals Council and it generally takes a year and a half to get a response to an appeal.  The Appeals Council awards benefits in very few cases and sends less than one in four cases back to the Administrative Law Judge who previously denied the claim for a rehearing and new decision.  Few rehearings are heard by a new judge.  Mostly, the Appeals Council declines to review the case, saying very little about the appeal.  New applications during the wait at the Appeals Council are generally refused unless there is a new and critical disabling condition and the Appeals Council gives special permission to appeal. These grim facts about the Appeals Council highlight why it is terribly important to get fully prepared to present convincing evidence of disability at a hearing and not to rely on an appeal instead of getting legal help well in advance of the hearing.
